Terms of Service

Please read these terms carefully. By creating an account or using this service, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

1. About the Service

Rental Analyst ("the Service") is a web-based real estate investment analytics platform based in Ontario, Canada. The Service allows users to analyze Canadian residential rental properties using financial metrics including cash flow, DSCR, cap rate, cash-on-cash return, and related calculations.

Important limitation: Rental Analyst provides financial calculations and informational tools only. It does not constitute financial advice, investment advice, legal advice, mortgage advice, or tax advice. All outputs are estimates based on inputs you provide. You should consult qualified professionals before making investment decisions.

2. Eligibility and Account Registration

To use the Service, you must:

  • Be at least 18 years of age
  • Be a resident of Canada or be accessing the Service for lawful purposes
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us promptly of any unauthorized use of your account

You are responsible for all activity that occurs under your account. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. Subscription Plans and Billing

The Service is offered on a freemium basis with paid subscription tiers. By subscribing to a paid plan, you agree to the following:

Free plan:

Available at no charge with limited features as described on the pricing page. No payment information required.

Paid plans (Investor and Portfolio):

  • Billed monthly or annually as selected at checkout
  • All prices are in Canadian dollars (CAD) unless otherwise stated
  • Applicable Canadian taxes (HST/GST/PST/QST) will be added at checkout based on your province of residence
  • Payment is processed by Stripe Inc. under their terms of service
  • Subscriptions renew automatically until cancelled

Free trial:

New paid subscribers receive a 14-day free trial. No charge is made until the trial period ends. You may cancel at any time during the trial without charge.

Price changes:

We may change subscription prices with at least 30 days' written notice to your registered email address. Continued use after the notice period constitutes acceptance of the new price.

4. Cancellation and Refunds

Cancellation:

You may cancel your subscription at any time through your account settings or by contacting info@rentalanalyst.ca. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.

Refunds:

We offer a pro-rated refund for the unused portion of your current billing period if you cancel within 7 days of a renewal charge. Requests must be submitted to info@rentalanalyst.ca within 7 days of the charge. No refunds are issued for annual plans after 14 days from purchase or renewal, except where required by applicable Canadian consumer protection law.

Quebec residents:

Residents of Quebec may have additional cancellation and refund rights under the Quebec Consumer Protection Act (Loi sur la protection du consommateur). These rights are not limited by these Terms.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable Canadian federal or provincial law or regulation
  • Provide false, misleading, or fraudulent property data
  • Attempt to gain unauthorized access to any part of the Service or other users' accounts
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use automated tools (scrapers, bots) to access or collect data from the Service
  • Resell, sublicense, or commercialize the Service or its outputs without our written consent
  • Use the Service in any manner that could damage, disable, or impair our systems

6. Your Data and Content

You retain ownership of all property data and information you enter into the Service. By using the Service, you grant us a limited licence to store and process that data solely to provide the Service to you.

We may use aggregated, anonymized, non-identifiable data (e.g., average cap rates across user-entered properties by city) for product improvement and research purposes. This data will never identify you or your specific properties.

You are responsible for the accuracy of data you enter. The Service's calculations are only as accurate as the inputs provided.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) calculations or projections will be accurate or complete; (c) the Service will meet your specific requirements; or (d) any errors will be corrected.

Financial calculations disclaimer: All metrics produced by the Service (including cash flow, DSCR, cap rate, IRR, and all other outputs) are estimates based on user-provided inputs and standardized assumptions. They are not guaranteed to reflect actual market conditions, lender requirements, or investment outcomes. Past performance of any referenced benchmarks does not guarantee future results.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, RENTAL ANALYST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 CAD.

Some provinces do not allow exclusion of implied warranties or limitation of liability for consequential damages. In such provinces, our liability is limited to the greatest extent permitted by law.

9. Intellectual Property

The Service, including its design, code, algorithms, and content (excluding user-entered data), is the exclusive property of Rental Analyst and is protected by Canadian copyright law and applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written consent.

The Rental Analyst name, logo, and related branding are proprietary to us. Nothing in these Terms grants you a right to use our trademarks.

10. Third-Party Services

The Service integrates with third-party services including Supabase (infrastructure), Stripe (payments), and Vercel (hosting). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of these third parties.

11. Service Availability and Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. For paid subscribers, we will provide at least 30 days' notice before discontinuing the Service entirely, and will offer a pro-rated refund for prepaid periods.

We may update features, change or remove functionality, or adjust free-tier limitations with reasonable notice. We will not materially reduce the core features of a paid plan without offering a comparable alternative or refund.

12. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

The current version of these Terms is always available at rentalanalyst.ca/terms.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the Service shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Ontario under the Arbitration Act, 1991 (Ontario), except that either party may seek injunctive relief in the courts of Ontario for intellectual property violations.

Quebec residents: Nothing in these Terms limits your rights under Quebec's Consumer Protection Act or other mandatory Quebec consumer protection legislation. Quebec courts retain jurisdiction for disputes involving Quebec consumer protection law.
